The National Consultative Committee on Racism and Interculturalism (NCCRI) was established in 1998 and is an independent expert body, primarily funded by the Department of Justice, Equality and Law Reform, focusing on racism and interculturalism. This is the 15TH NCCRI News, a monthly e-bulletin, designed to provide relevant and up to date information in the areas of anti-racism and interculturalism. If you have information about events, campaigns, initiatives or publications etc related to racism and interculturalism in Ireland, we would like to hear from you. Please note that the email bulletin goes out the second week of each month.

1. Policy and Legislative Developments

Government Legislative Programme

Irish Nationality and Citizenship (Amendment) Bill 2004
The Citizenship Bill, which sets out the citizenship rights of children born here to non-nationals is due to be enacted before Christmas. The Bill, to give effect to the result of the citizenship referendum held earlier this year, was published at the end of September by the Minister for Justice, Mr McDowell. It says a child may become an Irish citizen if at least one of its parents has been legally resident here for more than three years. Groups which campaigned against the proposal in May raised immediate concerns that time spent in this State or Northern Ireland, as either a student or an asylum-seeker, could not be counted when calculating a person's period of residence here.

Among the other main provisions of the Bill are that where one of its parents is a British citizen, a baby born on the island will be entitled to citizenship irrespective of the duration of stay of the parents, and that a baby born on the island to non-national parents, where one is on a diplomatic posting here, will no longer be entitled to citizenship.

Many groups including the NCCRI have said there was now no reason not to regularise the status of the estimated 11,000 non-EU parents of Irish children who applied for residency based on the birth of a child here, before the Supreme Court decided in January 2003 that people could not automatically claim Irish residency on this basis.

Judicial Review Leave Granted to Nigerian National
The High Court ruled in October that a Nigerian mother may bring a legal challenge to the decision of the Department of Justice, Equality and Law Reform not to consider her claim for residency on the basis of the scheme abolished in February 2003. Her application was made two weeks before the scheme was abolished. The Department later announced in July that it would not be considering outstanding applications made before the 19th of February 2003. Judge Geoghegan ruled that the Nigerian national had established substantial grounds to support her claim that she had a legitimate expectation to have her application for residency determined in accordance with the administrative scheme which was abolished in February 2003. The full hearing of this case is due to take place before Christmas.

Launch of Healthcare plan to accommodate 200,000 from ethnic minorities
An estimated 200,000 people from many ethnic minority groups, over 100 countries and 160 nationalities are now living in Ireland, speaking 80 to 100 languages. The new 19-point plan to improve the health care and personal social services provision of ethnic minority communities in the eastern region was developed by the Eastern Regional Health Authority (ERHA). There are three main pillars in the strategy, including the development of an interpretation service, support and resourcing of non-governmental organisations to work in partnership with people from ethnic minority communities so that their own skills and expertise inform health-service planning. Ireland’s Report to CERD
Ireland’s report is due to be examined in the 66th session (21 February-11 March 2005) before the Committee of the Convention on the Elimination of all Forms of Racial Discrimination. The secretary of the CERD Committee has advised the NCCRI that NGOs interested in submitting a shadow/alternative report should do so well in advance, preferably by the 14 January. 40 copies of the report are required. If groups cannot meet the 14 January deadline, it is advisable to send 20 copies one week prior to the meeting (i.e. 14 February).

The NCCRI in association with the Human Rights Commission will hold an information seminar on CERD with the secretary of the CERD Committee, Ms. Natalie Prouvez, on Monday 22nd of November 2004 in the Parnell Room, Jury’s Inn, Parnell Street, Dublin 1. Spousal Work Permits Scheme
An Tánaiste recently announced the introduction of new arrangements which will be confined to the spouses of certain categories of non-EEA employees in the State. These new arrangements will give greater ease of access to employment for eligible spouses, under specified schemes and facilities. The Spousal Work Permits Scheme does not generally cover the spouses of persons working in the state on foot of work permits. For more information

Call for Submissions
The National Economic and Social Forum (NESF) has recently established a Project Team on early childhood care and education. Submissions to the Team can be made in writing or by email. An Garda Siochana are also seeking submissions for their Policing Plan 2005. Submissions must be forwarded by November 1st 2004. The Policing Plan 2004 is available on their website at www.garda.ie

EU Developments

Chen Judgement
In May 2004, the Advocate General of the European Court of Justice (ECJ) gave his opinion in the Chen case, holding that a minor who is a national of a Member State is entitled to reside in another Member State provided that he or she is covered by sickness insurance and has sufficient resources to ensure that, during their stay, they do not become a burden on the public finances of the host Member State. He also found that, the mother of the EU citizen must be able to invoke a right of residence deriving from that of her young child because otherwise the child’s right would be entirely deprived of effectiveness. Council of Europe launches recommendation on fighting anti-Semitism
In September the European Commission against Racism and Intolerance (ECRI) of the Council of Europe launched a set of recommendations to governments across Europe on how to fight anti-Semitism. ECRI's ninth General Policy Recommendation follows the recent rise in anti-Semitic behaviour in many European countries, and is addressed to all 45 CoE member states. Among other things, ECRI urges governments to prosecute people who deny, trivialise or justify the Holocaust; make sure that racism laws apply to antisemitism on the internet, satellite television and other modern forms of communication; offer targeted training on antisemitic crimes to police, prosecutors and judges; encourage victims of antisemitism to come forward, and effectively monitor how their complaints are followed-up and provide anti-racist education at all levels in schools. EU Asylum Policy

ARGO
ARGO is a new action programme for administrative cooperation at EU level in the fields of asylum, visas, immigration and external borders. It partly replaces the Odysseus programme. It aims to promote cooperation between national administrations responsible for implementing EU rules, promote the uniform application of EU law and encourage transparency of actions taken by the national authorities and to improve the overall efficiency of national administrations in their tasks The programme supports training, staff exchanges, studies and conferences.

EU list of safe third countries
EU Member States are struggling to agree on the countries that should be on a common "white list" list from which asylum applications will be presumed to be unfounded. The current list includes the following countries: Benin, Botswana, Cape Verde, Chile, Costa Rica, Ghana, Mali, Mauritius, Senegal and Uruguay. Member States will be able to add other countries to their national list but they will not be able to remove countries from the Euro-list, even for humanitarian reasons. The National Action Plan Against Racism Grants Scheme for Anti-Racism Initiatives
The National Action Plan Against Racism (NPAR) will be published later this year. The overall aim of the plan is to provide strategic direction to combat racism and to develop a more inclusive, intercultural society in Ireland based on policies that promote interaction, equality of opportunity, understanding and respect. To support the aims of the plan, the Department of Justice, Equality and Law Reform in association with the National Consultative Committee on Racism and Interculturalism (NCCRI) have announced a grant scheme to enable organisations to raise awareness about racism and highlight cultural diversity in Ireland.

The initiative should seek to focus on at least one of the five themes of the NPAR, which are Protection, Inclusion, Provision, Recognition and Participation. For more information please see www.nccri.ie or Tel. 01-8588000 info@nccri.ie

Media Challenge Fund 2004 for radio, print and new media
Development Cooperation Ireland, the Government's official development assistance programme, invites applications from media outlets, journalists, photojournalists and development education organisations for grants for radio, print and new media projects, which are designed to increase awareness and understanding of global development issues. Anti-Racism in the Workplace Week 2004
On November 1st to November 7th 2004 the Equality Authority, Congress, CIF, IBEC, Chambers of Commerce Ireland, IFA, Small Firms Association and Department of Justice, Equality and Law Reform will organise enterprise initiatives to celebrate cultural diversity and to encourage a commitment to anti racism in the workplace. The launch of Anti-Racist Workplace Week will take place on Monday 1st of November at the Equality Authority with the launch of a new publication “Promoting Equality in Intercultural Workplaces”.

Human without rights: asylum seekers in the 21st century
An exhibition of photographs by David Levene of the Guardian Newspaper, brought to Belfast by the Law Centre (NI) and Refugee Action Group as part of Belfast Festival at Queens. Venue: Law Centre (NI), 124 Donegall Street, Belfast. From Saturday 23 October to Saturday 6 November, 10 am to 4 pm. Closed: Tuesdays and Sundays.

European Constituency Meetings with MEPs
EAPN Ireland is organising a series of round-table meetings with Members of the European Parliament during the week of 1-5 November. The idea is to provide a forum within which MEPs can meet with and deal with issues raised by community and anti-poverty groups and organisations in different constituencies.

Human Rights and the Workplace: City Bridges Seminar
City Bridges in partnership with the Irish Congress of Trade Unions and the Amalgamated Transport and General Workers Union is holding a half day seminar on Human Rights and the Workplace on Thursday 28 October 2004 in the Carrickdale Hotel, Dundalk from 10am to 1.00pm. Keynote speakers are Keith Ewing, Professor of Public Law at Kings College, London and Ivana Bacik, Reid Professor of Criminal Law, Criminology and Penology at TCD. Attendance at the seminar is free. A network of Italian social cooperatives (CONEDIS) is promoting two Daphne projects and is looking for Irish Partners. The first project is about preventing violence against children in Travellers/Roma community. Conference: Understanding Islam
The Chester Beatty Library presents two days of lectures by renowned specialists in Islamic Studies from Ireland, UK, North America and Germany. European Stop Discrimination Truck Tour
The European Anti-Discrimination Truck Tour, which aims to inform people about EU anti-discrimination laws will visit Ireland this week. Race and State conference: Call for Papers
Conference organised by the MPhil in Ethnic and Racial Studies, Department of Sociology, University of Dublin, Trinity College in association with the British Sociological Association's Race and Ethnicity Study Group, and the Sociological Association of Ireland (SAI). 30-31 March 2005 Emmet Lecture Hall, Arts Building, Trinity College Dublin.
